What are actions after checking application for trực tiếp bóng đá k+ duty-free list applied to exported and imported goods in Vietnam?

Pursuant to Article 3 Section 1 Chapter I of trực tiếp bóng đá k+ Procedures for duty exemption, duty reduction, duty refund, duty cancellation, handling of overpaid duties, late payment interests, and fines for exported and imported goods issued together with trực tiếp bóng đá k+ Decision 3394/QĐ-TCHQ in 2021 stipulating actions after checking application for trực tiếp bóng đá k+ duty-free list applied to exported and imported goods in Vietnam as follows:

1. For trực tiếp bóng đá k+ electronic duty-free list sent through trực tiếp bóng đá k+ VNACCS

a) In case of requesting trực tiếp bóng đá k+ project owner to supplement, explain

a.1) trực tiếp bóng đá k+ processing officer shall make a Report form No. 01/TT-TXNK issued together with this Procedure together with trực tiếp bóng đá k+ application and report to trực tiếp bóng đá k+ head of division and submit it to trực tiếp bóng đá k+ head of unit for approval.

a.2) Input instructions for supplementation and explanation into trực tiếp bóng đá k+ System and give feedback to trực tiếp bóng đá k+ project owner via CTL (Code I).

a.2.1) In case trực tiếp bóng đá k+ project owner makes supplementation and explanation

In case trực tiếp bóng đá k+ project owner or trực tiếp bóng đá k+ person authorized by trực tiếp bóng đá k+ project owner explains in person to trực tiếp bóng đá k+ customs authority, trực tiếp bóng đá k+ processing officer shall make a working record using form No. 12/TXNK Appendix I issued with Circular No. 06/2021/TT-BTC dated January 22, 2021 of trực tiếp bóng đá k+ Minister of Finance on guidelines for trực tiếp bóng đá k+ Law on Tax Administration dated June 13, 2019 on tax administration for exported and imported goods.

After trực tiếp bóng đá k+ project owner makes supplementation and explanation, trực tiếp bóng đá k+ processing officer shall follow trực tiếp bóng đá k+ instructions in Articles 2 and 3 of this Procedure.

a.2.2) In case trực tiếp bóng đá k+ project owner fails to make supplementation or explanation

After 05 working days from trực tiếp bóng đá k+ date trực tiếp bóng đá k+ customs authority responds through trực tiếp bóng đá k+ VNACCS, if trực tiếp bóng đá k+ project owner fails to make any supplementation or explanation, trực tiếp bóng đá k+ customs authority shall notify trực tiếp bóng đá k+ project owner of trực tiếp bóng đá k+ ineligibility for receiving trực tiếp bóng đá k+ duty-free list.

b) Eligibility for receiving trực tiếp bóng đá k+ duty-free list

b.1) trực tiếp bóng đá k+ processing officer shall make a report form No. 01/TT-TXNK issued together with this Procedure together with trực tiếp bóng đá k+ application and report to trực tiếp bóng đá k+ head of division and submit it to trực tiếp bóng đá k+ head of unit for approval.

b.2) Issue a general management code according to trực tiếp bóng đá k+ following structure: Code of applicant for registration of duty-free list-year of registration-ordinal number (Example: 34CC-2015-001).

General management code is trực tiếp bóng đá k+ code assigned to each duty-free project. Each project can have multiple electronic duty-free lists. trực tiếp bóng đá k+ issuance of trực tiếp bóng đá k+ general management code is monitored by an external register of trực tiếp bóng đá k+ VNACCS and updated in trực tiếp bóng đá k+ "General management code" entry when approving trực tiếp bóng đá k+ electronic duty-free list.

b.3) Input processing result information into VNACCS and give feedback to project owner via CTL (code A).

b.4) In case it is important to note that trực tiếp bóng đá k+ customs authority where trực tiếp bóng đá k+ import procedures are carried out to check details (Example: Checking trực tiếp bóng đá k+ eligibility requirements pertaining to creating fixed assets; trực tiếp bóng đá k+ goods that have not been produced domestically; ...) trực tiếp bóng đá k+ processing officer shall:

- In trực tiếp bóng đá k+ report made according to form No. 01/TT-TXNK issued together with this Procedure, trực tiếp bóng đá k+ processing officer shall report to trực tiếp bóng đá k+ head of unit trực tiếp bóng đá k+ contents that need to be noticed by trực tiếp bóng đá k+ customs authority where customs procedures are carried out in order to check details;

- In trực tiếp bóng đá k+ notes section of trực tiếp bóng đá k+ customs authority on trực tiếp bóng đá k+ duty-free list, trực tiếp bóng đá k+ processing officer shall clearly specify trực tiếp bóng đá k+ contents to be noted for trực tiếp bóng đá k+ customs authority where trực tiếp bóng đá k+ import procedures are carried out to check details.

c) In case trực tiếp bóng đá k+ duty-free list is not accepted

c.1) trực tiếp bóng đá k+ processing officer shall make a Report form No. 01/TT-TXNK issued together with this Procedure together with trực tiếp bóng đá k+ application and report to trực tiếp bóng đá k+ head of division and submit it to trực tiếp bóng đá k+ head of unit for approval.

c.2) Input information into trực tiếp bóng đá k+ VNACCS about non-receipt of trực tiếp bóng đá k+ duty-free list (goods not eligible for duty exemption) and respond to trực tiếp bóng đá k+ project owner via CTL (code N).

trực tiếp bóng đá k+ processing officer transfers all trực tiếp bóng đá k+ documents attached to trực tiếp bóng đá k+ duty-free list registration application to trực tiếp bóng đá k+ clerical department to send back to trực tiếp bóng đá k+ project owner.

2. For trực tiếp bóng đá k+ paper duty-free list

a) In case of requesting trực tiếp bóng đá k+ project owner to supplement, explain

a.1) trực tiếp bóng đá k+ processing officer shall make a report according to form No. 01/TT-TXNK issued together with trực tiếp bóng đá k+ Process, a draft notice to send to trực tiếp bóng đá k+ project owner about trực tiếp bóng đá k+ supplementation and explanation of trực tiếp bóng đá k+ application, made according to trực tiếp bóng đá k+ form No. 05/ TXNK Appendix I promulgated together with Circular No. 06/2021/TT-BTC with trực tiếp bóng đá k+ application and report to head of division for submission to trực tiếp bóng đá k+ head of unit for approval.

a.2) trực tiếp bóng đá k+ processing officer shall transfer trực tiếp bóng đá k+ notice of supplementation and explanation of trực tiếp bóng đá k+ duty-free list registration application to trực tiếp bóng đá k+ clerical department to send to trực tiếp bóng đá k+ project owner.

a.2.1) In case trực tiếp bóng đá k+ project owner makes supplementation and explanation

In case trực tiếp bóng đá k+ project owner or trực tiếp bóng đá k+ person authorized by trực tiếp bóng đá k+ project owner explains in person to trực tiếp bóng đá k+ customs authority, trực tiếp bóng đá k+ processing officer shall make a working record using form No. 12/TXNK Appendix I issued with Circular No. 06/2021/TT-BTC.

After trực tiếp bóng đá k+ project owner has supplemented and explained trực tiếp bóng đá k+ duty-free list registration application, trực tiếp bóng đá k+ processing officer shall perform trực tiếp bóng đá k+ tasks sequentially according to trực tiếp bóng đá k+ instructions in Articles 2 and 3 of this Procedure.

a.2.2) In case trực tiếp bóng đá k+ project owner fails to make supplementation and explanation

After 05 working days from trực tiếp bóng đá k+ date trực tiếp bóng đá k+ project owner receives trực tiếp bóng đá k+ paper notification from trực tiếp bóng đá k+ customs authority about trực tiếp bóng đá k+ supplementation and explanation of trực tiếp bóng đá k+ application, but trực tiếp bóng đá k+ project owner does not make trực tiếp bóng đá k+ supplementation or explanation, trực tiếp bóng đá k+ customs authority shall notify trực tiếp bóng đá k+ project owner of insufficient grounds to receive trực tiếp bóng đá k+ duty-free list.

b) Eligibility for receiving trực tiếp bóng đá k+ duty-free list

b.1) trực tiếp bóng đá k+ processing officer shall make a Report form No. 01/TT-TXNK issued together with this Procedure together with trực tiếp bóng đá k+ application and report to trực tiếp bóng đá k+ head of division and submit it to trực tiếp bóng đá k+ head of unit for approval.

After trực tiếp bóng đá k+ head of unit approves 02 duty-free lists and 01 original of trực tiếp bóng đá k+ deduction monitoring sheet, trực tiếp bóng đá k+ officer shall input trực tiếp bóng đá k+ monitoring book of trực tiếp bóng đá k+ duty-free list, trực tiếp bóng đá k+ deduction monitoring sheet and transfer trực tiếp bóng đá k+ clerical department to stamp, issue and return to trực tiếp bóng đá k+ project owner 01 original of trực tiếp bóng đá k+ duty-free list, 01 original of trực tiếp bóng đá k+ deduction monitoring sheet; save 01 original of trực tiếp bóng đá k+ duty-free list.

Notes: In case of receiving trực tiếp bóng đá k+ duty-free list registration application by combination or assembly line, only trực tiếp bóng đá k+ duty-free list is required, trực tiếp bóng đá k+ deduction monitoring sheet is not required.

b.2) In case it is important to note that trực tiếp bóng đá k+ customs authority where trực tiếp bóng đá k+ import procedures are carried out to check details (Example: Checking trực tiếp bóng đá k+ eligibility requirements pertaining to creating fixed assets; trực tiếp bóng đá k+ goods that have not been produced domestically; ...) trực tiếp bóng đá k+ processing officer shall:

- In trực tiếp bóng đá k+ report made according to form No. 01/TT-TXNK issued together with this Procedure, trực tiếp bóng đá k+ processing officer shall report to trực tiếp bóng đá k+ head of unit trực tiếp bóng đá k+ contents that need to be noticed by trực tiếp bóng đá k+ customs office where customs procedures are carried out in order to check details;

- In trực tiếp bóng đá k+ notes section of trực tiếp bóng đá k+ customs authority on trực tiếp bóng đá k+ duty-free list, trực tiếp bóng đá k+ processing officer shall clearly specify trực tiếp bóng đá k+ contents to be noted for trực tiếp bóng đá k+ customs authority where trực tiếp bóng đá k+ import procedures are carried out to check details.

c) In case trực tiếp bóng đá k+ duty-free list is not accepted

trực tiếp bóng đá k+ processing officer shall make a report according to form No. 01/TT-TXNK issued together with trực tiếp bóng đá k+ Process, a draft notice to send to trực tiếp bóng đá k+ project owner about non-receipt of trực tiếp bóng đá k+ duty-free list, made according to trực tiếp bóng đá k+ form No. 06/ TXNK Appendix I promulgated together with Circular No. 06/2021/TT-BTC with trực tiếp bóng đá k+ application and report to head of division for submission to trực tiếp bóng đá k+ head of unit for approval.

After trực tiếp bóng đá k+ head of unit approves, trực tiếp bóng đá k+ processing officer will transfer trực tiếp bóng đá k+ notice with trực tiếp bóng đá k+ entire duty-free list registration application to trực tiếp bóng đá k+ clerical department to send to trực tiếp bóng đá k+ project owner.

What are procedures for checking trực tiếp bóng đá k+ completeness and validity of trực tiếp bóng đá k+ application for trực tiếp bóng đá k+ duty-free list applied to exported and imported goods in Vietnam?

Pursuant to Clause 1 Article 2 Section 1 Chapter I of trực tiếp bóng đá k+ Procedures for duty exemption, duty reduction, duty refund, duty cancellation, handling of overpaid duties, late payment interests, and fines for exported and imported goods issued together with trực tiếp bóng đá k+ Decision 3394/QĐ-TCHQ in 2021 stipulating procedures for checking trực tiếp bóng đá k+ completeness and validity of trực tiếp bóng đá k+ application for trực tiếp bóng đá k+ duty-free list applied to exported and imported goods in Vietnam as follows:

Officers assigned to process applications (including trực tiếp bóng đá k+ electronic duty-free list and paper duty-free list) shall do trực tiếp bóng đá k+ following:

1. Check trực tiếp bóng đá k+ completeness and validity of trực tiếp bóng đá k+ application

Check trực tiếp bóng đá k+ duty-free list registration application in accordance with Clause 3, Article 30 of Decree No. 134/2016/ND-CP as amended and supplemented in Clause 13, Article 1 of Decree No. 18/2021/ND-CP, in specific:

a) Check trực tiếp bóng đá k+ completeness of trực tiếp bóng đá k+ documents in trực tiếp bóng đá k+ duty-free list registration application;

b) Check trực tiếp bóng đá k+ validity of original, photocopy.

Pursuant to Clause 2 Article 2 Section 1 Chapter I of trực tiếp bóng đá k+ Procedures for duty exemption, duty reduction, duty refund, duty cancellation, handling of overpaid duties, late payment interests, and fines for exported and imported goods issued together with trực tiếp bóng đá k+ Decision 3394/QĐ-TCHQ in 2021 stipulating procedures for checking trực tiếp bóng đá k+ details of trực tiếp bóng đá k+ duty-free list registration application and compare with relevant law provisions regarding exported and imported goods in Vietnam as follows:

2. Check trực tiếp bóng đá k+ details of trực tiếp bóng đá k+ duty-free list registration application and compare with relevant law provisions

a) Check trực tiếp bóng đá k+ contents in trực tiếp bóng đá k+ duty-free list registration application

a.1) Information about trực tiếp bóng đá k+ enterprise: Name, address, TIN of trực tiếp bóng đá k+ enterprise, business lines and fields;

a.2) Information about trực tiếp bóng đá k+ project: Project name, objectives, scale and capacity of trực tiếp bóng đá k+ project, field and area of ​​implementation of trực tiếp bóng đá k+ investment project, time limit for disbursement of trực tiếp bóng đá k+ project, number of employees of trực tiếp bóng đá k+ project (if any), economic and technical evaluation, technical documents of trực tiếp bóng đá k+ project;

a.3) Information about duty-free imported goods: Name, quality specification, quantity, type, unit, expected value/value, and corresponding duty-free code on trực tiếp bóng đá k+ duty-free list;

a.4) Information in relevant documents specified in Clause 3, Article 30 of Decree No. 134/2016/ND-CP, as amended and supplemented in Clause 13, Article 1 of Decree No. 18/2021/ND-CP;

a.5) Electronic data on trực tiếp bóng đá k+ data processing system of trực tiếp bóng đá k+ customs authority, other relevant documents and data collected by trực tiếp bóng đá k+ customs authority (if any).

b) Check duty exemption conditions

b.1) Check if trực tiếp bóng đá k+ goods on trực tiếp bóng đá k+ duty-free list are eligible for investment incentives, tax incentives and eligible for duty-free list registration;

b.2) Check if trực tiếp bóng đá k+ goods on trực tiếp bóng đá k+ duty-free list are eligible for trực tiếp bóng đá k+ investment business lines, objectives, scale and capacity of trực tiếp bóng đá k+ project, production facilities, and use of duty-free goods; consistent with trực tiếp bóng đá k+ technical and economic evaluation, trực tiếp bóng đá k+ project's technical documents and other relevant documents (if any); has corresponding quantities, categories and value of trực tiếp bóng đá k+ agricultural products to be harvested stated in trực tiếp bóng đá k+ contract or agreement with trực tiếp bóng đá k+ Cambodian party on investment assistance, farming and receiving agricultural products;

b.3) Check trực tiếp bóng đá k+ goods on trực tiếp bóng đá k+ duty-free list, if they are eligible for duty exemption because they meet trực tiếp bóng đá k+ condition that they cannot be produced domestically, they must not be on trực tiếp bóng đá k+ list of goods that can be produced domestically according to regulations and on guidelines for documents of trực tiếp bóng đá k+ Ministry of Planning and Investment;

b.4) Compare with trực tiếp bóng đá k+ grounds for determining duty-free imported goods according to regulations of relevant ministries and central authorities;

b.5) ​​Compare with guiding documents of trực tiếp bóng đá k+ Ministry of Finance and trực tiếp bóng đá k+ General Department of Customs (if any).
