From January 1, 2025, is it possible to file supplementary tax returns when there is a tax audit or inspection decision in Vietnam?

Based on Clause 1, Article 47 of xoilac tv trực tiếp bóng đá hôm nayLaw on Tax Administration 2019(amended by Point a, Clause 6, Article 6 of xoilac tv trực tiếp bóng đá hôm nayLaw Amending xoilac tv trực tiếp bóng đá hôm nay Securities Law, Accounting Law, Independent Audit Law, State Budget Law, Law on Management and Use of Public Assets, Tax Administration Law, Personal Income Tax Law, National Reserve Law, Law on Sanctioning Administrative Violations 2024) on supplementary tax returns:

Article 47. Supplementary tax returns

1. If xoilac tv trực tiếp bóng đá hôm nay taxpayer discovers that a tax return submitted to xoilac tv trực tiếp bóng đá hôm nay tax authority has errors, they may supplement xoilac tv trực tiếp bóng đá hôm nay tax return within 10 years from xoilac tv trực tiếp bóng đá hôm nay expiration date of xoilac tv trực tiếp bóng đá hôm nay filing deadline for xoilac tv trực tiếp bóng đá hôm nay tax period with xoilac tv trực tiếp bóng đá hôm nay error, in xoilac tv trực tiếp bóng đá hôm nay following cases:

a) Before xoilac tv trực tiếp bóng đá hôm nay tax authority or competent authority announces a tax inspection or audit decision;

b) xoilac tv trực tiếp bóng đá hôm nay documents are not within xoilac tv trực tiếp bóng đá hôm nay scope or period specified in xoilac tv trực tiếp bóng đá hôm nay tax inspection or audit decision.

For xoilac tv trực tiếp bóng đá hôm nay content within xoilac tv trực tiếp bóng đá hôm nay scope of inspection or audit, xoilac tv trực tiếp bóng đá hôm nay taxpayer may supplement explanatory documents under xoilac tv trực tiếp bóng đá hôm nay provisions of tax law, inspection law, and in accordance with conclusions and regulations of xoilac tv trực tiếp bóng đá hôm nay competent sectoral authority related to xoilac tv trực tiếp bóng đá hôm nay taxpayer's tax obligations.

According to xoilac tv trực tiếp bóng đá hôm nay above provisions, if a taxpayer discovers an error in a tax return submitted to xoilac tv trực tiếp bóng đá hôm nay tax authority, they may suplement xoilac tv trực tiếp bóng đá hôm nay document within 10 years from xoilac tv trực tiếp bóng đá hôm nay expiration of xoilac tv trực tiếp bóng đá hôm nay filing deadline for xoilac tv trực tiếp bóng đá hôm nay tax period with xoilac tv trực tiếp bóng đá hôm nay error, provided it is before xoilac tv trực tiếp bóng đá hôm nay tax authority or competent authority announces xoilac tv trực tiếp bóng đá hôm nay inspection or audit decision.

Thus, if xoilac tv trực tiếp bóng đá hôm nay tax authority or competent authority has announced a tax inspection or audit decision at xoilac tv trực tiếp bóng đá hôm nay taxpayer's premises, supplements to tax returns cannot be made.

Will taxpayers in Vietnam be penalized if they submit a supplementary tax returns?

Based on Clause 3, Article 9 ofDecree 125/2020/ND-CPon cases that are exempt from administrative penalties regarding taxes and invoices:

Article 9. Cases exempt from administrative penalties regarding taxes and invoices

3. No administrative penalty on tax violations for xoilac tv trực tiếp bóng đá hôm nay case of incorrect declarations, where xoilac tv trực tiếp bóng đá hôm nay taxpayer has supplemented xoilac tv trực tiếp bóng đá hôm nay tax return and self-paid xoilac tv trực tiếp bóng đá hôm nay full amount of tax due before xoilac tv trực tiếp bóng đá hôm nay tax authority announces xoilac tv trực tiếp bóng đá hôm nay inspection or audit decision at xoilac tv trực tiếp bóng đá hôm nay taxpayer's premises or before xoilac tv trực tiếp bóng đá hôm nay tax authority discovers xoilac tv trực tiếp bóng đá hôm nay issue without an inspection or audit at xoilac tv trực tiếp bóng đá hôm nay taxpayer's premises or before another competent authority discovers it.

4. No penalty for procedural violations regarding tax for individuals directly finalizing personal income tax late when there is a tax refund; business households, and individual businesses already assessed for tax according to Article 51 of xoilac tv trực tiếp bóng đá hôm nay Tax Administration Law.

5. No penalty for violations of xoilac tv trực tiếp bóng đá hôm nay tax filing deadline during xoilac tv trực tiếp bóng đá hôm nay period xoilac tv trực tiếp bóng đá hôm nay taxpayer is granted an extension for that tax filing.

According to these regulations, taxpayers submitting supplementary tax returns upon discovering errors and who have self-paid xoilac tv trực tiếp bóng đá hôm nay full amount of tax due before xoilac tv trực tiếp bóng đá hôm nay following instances, will not be penalized:

- Before xoilac tv trực tiếp bóng đá hôm nay tax authority announces xoilac tv trực tiếp bóng đá hôm nay tax inspection or audit decision at xoilac tv trực tiếp bóng đá hôm nay taxpayer's premises

- Before xoilac tv trực tiếp bóng đá hôm nay tax authority discovers xoilac tv trực tiếp bóng đá hôm nay issue without an inspection or audit at xoilac tv trực tiếp bóng đá hôm nay taxpayer's premises

- Before another competent authority discovers it

What methods can taxpayers in Vietnamuse to submit tax returns?

Based on Article 48 of xoilac tv trực tiếp bóng đá hôm nayLaw on Tax Administration 2019stipulating xoilac tv trực tiếp bóng đá hôm nay responsibilities of tax management authorities in receiving tax returns:

Article 48. Responsibilities of tax management authorities in receiving tax returns

1. xoilac tv trực tiếp bóng đá hôm nay tax management authority shall receive xoilac tv trực tiếp bóng đá hôm nay taxpayer's filing documents through xoilac tv trực tiếp bóng đá hôm nay following methods:

a) Direct submission at xoilac tv trực tiếp bóng đá hôm nay tax management authority;

b) Submission by postal mail;

c) Submission electronically through xoilac tv trực tiếp bóng đá hôm nay tax management authority’s electronic transaction portal.

2. xoilac tv trực tiếp bóng đá hôm nay tax management authority shall notify xoilac tv trực tiếp bóng đá hôm nay receipt of xoilac tv trực tiếp bóng đá hôm nay tax returns; if xoilac tv trực tiếp bóng đá hôm nay documents are unlawful, incomplete, or not in accordance with xoilac tv trực tiếp bóng đá hôm nay prescribed form, notify xoilac tv trực tiếp bóng đá hôm nay taxpayer within 3 working days from receipt of xoilac tv trực tiếp bóng đá hôm nay documents.

Taxpayers submit tax returns to xoilac tv trực tiếp bóng đá hôm nay tax management authority through xoilac tv trực tiếp bóng đá hôm nay following methods:

- Direct submission at xoilac tv trực tiếp bóng đá hôm nay tax management authority

- Submission by postal mail

- Submission through xoilac tv trực tiếp bóng đá hôm nay electronic transaction portal of xoilac tv trực tiếp bóng đá hôm nay tax management authority.
