1. What are vtv5 trực tiếp bóng đá hôm nay cases of giving rise to liability to compensate for damage in Vietnam?

Article 584 of vtv5 trực tiếp bóng đá hôm nayLaw No. 91/2015/QH13stipulates vtv5 trực tiếp bóng đá hôm nay grounds giving rise to liability to compensate for damage as follows:

Grounds giving rise to liability to compensate for damage

2. What is permanent disability?

Permanent disability is damage to vtv5 trực tiếp bóng đá hôm nay body caused by an accident or disease, leading to vtv5 trực tiếp bóng đá hôm nay permanent loss of normal function of one or more body parts. This condition cannot be reversed with current medical treatments.

There are two types of permanent disability:

Damage caused by harm to health

1. Damage caused by harm to health shall comprise:

a) Reasonable costs for treating, nursing and rehabilitating health, and functional losses and impairment of vtv5 trực tiếp bóng đá hôm nay aggrieved person;

b) Loss of or reduction in vtv5 trực tiếp bóng đá hôm nay actual income of vtv5 trực tiếp bóng đá hôm nay aggrieved person. If vtv5 trực tiếp bóng đá hôm nay actual income of vtv5 trực tiếp bóng đá hôm nay aggrieved person is irregular and is not able to be determined, vtv5 trực tiếp bóng đá hôm nay average income level for vtv5 trực tiếp bóng đá hôm nay type of work performed by vtv5 trực tiếp bóng đá hôm nay aggrieved person shall be applied;

c) Reasonable costs and actual income losses of vtv5 trực tiếp bóng đá hôm nay carers of vtv5 trực tiếp bóng đá hôm nay aggrieved person during vtv5 trực tiếp bóng đá hôm nay period of treatment. If vtv5 trực tiếp bóng đá hôm nay aggrieved person loses his or her ability to work and requires a permanent carer, vtv5 trực tiếp bóng đá hôm nay damage shall also include reasonable costs for taking care of vtv5 trực tiếp bóng đá hôm nay aggrieved person.

d) Other damage as prescribed by law.

2. A person causing harm to vtv5 trực tiếp bóng đá hôm nay health of another person must pay vtv5 trực tiếp bóng đá hôm nay items provided in Clause 1 of this Article together with an amount of money as compensation for mental suffering of vtv5 trực tiếp bóng đá hôm nay aggrieved person. vtv5 trực tiếp bóng đá hôm nay amount of compensation for mental suffering shall be as agreed by vtv5 trực tiếp bóng đá hôm nay parties; if vtv5 trực tiếp bóng đá hôm nay parties are not able to agree, vtv5 trực tiếp bóng đá hôm nay maximum sum shall not exceed fifty-month base salary prescribed by vtv5 trực tiếp bóng đá hôm nay State.

In addition, according to vtv5 trực tiếp bóng đá hôm nay provisions of Article 7 ofResolution No. 02/2022/NQ-HDTP, regulations on damages for harm to health are as follows:

1. Reasonable costs for treating, nursing and rehabilitating health, and functional losses and impairment of vtv5 trực tiếp bóng đá hôm nay aggrieved person. including;

a) Expenses for medical examination and treatment in accordance with vtv5 trực tiếp bóng đá hôm nay law on medical examination and treatment for vtv5 trực tiếp bóng đá hôm nay aggrieved person; hiring vehicles to take vtv5 trực tiếp bóng đá hôm nay aggrieved person to vtv5 trực tiếp bóng đá hôm nay health facility and back to their place of residence;

b) vtv5 trực tiếp bóng đá hôm nay cost of improving health of vtv5 trực tiếp bóng đá hôm nay aggrieved person is determined as 01 day of regional minimum wage at vtv5 trực tiếp bóng đá hôm nay health facility for 01 day of medical examination and treatment according to vtv5 trực tiếp bóng đá hôm nay number of days in vtv5 trực tiếp bóng đá hôm nay medical record;

c) vtv5 trực tiếp bóng đá hôm nay cost of health recovery and health rehabilitation includes expenses for vtv5 trực tiếp bóng đá hôm nay recovery, support or replacement of a part of lost or reduced functions of vtv5 trực tiếp bóng đá hôm nay aggrieved person’s body.

2. vtv5 trực tiếp bóng đá hôm nay actual lost or reduced income of vtv5 trực tiếp bóng đá hôm nay aggrieved person is determined as follows:

a) In case vtv5 trực tiếp bóng đá hôm nay aggrieved person has a stable income from salary or wages, it shall be determined according to vtv5 trực tiếp bóng đá hôm nay salary or wage amount of vtv5 trực tiếp bóng đá hôm nay aggrieved person during vtv5 trực tiếp bóng đá hôm nay period of lost or reduced salary or wage;

b) In case vtv5 trực tiếp bóng đá hôm nay aggrieved person has an unstable income from salary or wage, vtv5 trực tiếp bóng đá hôm nay salary or wage is determined based on vtv5 trực tiếp bóng đá hôm nay average salary or wage amount of vtv5 trực tiếp bóng đá hôm nay 3 consecutive months preceding vtv5 trực tiếp bóng đá hôm nay time of loss. In case it is impossible to determine 03 consecutive months' salary before vtv5 trực tiếp bóng đá hôm nay time of loss, it shall be based on vtv5 trực tiếp bóng đá hôm nay average income of workers of vtv5 trực tiếp bóng đá hôm nay same type in vtv5 trực tiếp bóng đá hôm nay local area during vtv5 trực tiếp bóng đá hôm nay period when vtv5 trực tiếp bóng đá hôm nay actual income is lost or reduced. If it is impossible to determine vtv5 trực tiếp bóng đá hôm nay average income of workers of vtv5 trực tiếp bóng đá hôm nay same type in vtv5 trực tiếp bóng đá hôm nay local area, vtv5 trực tiếp bóng đá hôm nay actual lost or reduced income that is compensated is 01 day of regional minimum wage in vtv5 trực tiếp bóng đá hôm nay place where vtv5 trực tiếp bóng đá hôm nay aggrieved person resides for 01 day of loss.

Daily regional minimum wage equals 01 month's regional minimum wage as prescribed by vtv5 trực tiếp bóng đá hôm nay State divided by 26 days.

3. Reasonable expenses and actual lost income of caregiver(s) of vtv5 trực tiếp bóng đá hôm nay aggrieved person as prescribed at Point c, Clause 1, Article 590 of vtv5 trực tiếp bóng đá hôm nayCivil Codeare determined as follows:

a) Reasonable expenses for caregiver(s) of vtv5 trực tiếp bóng đá hôm nay aggrieved person during vtv5 trực tiếp bóng đá hôm nay treatment period, including: vehicle fares, and rented room rents according to vtv5 trực tiếp bóng đá hôm nay average prices in vtv5 trực tiếp bóng đá hôm nay place where vtv5 trực tiếp bóng đá hôm nay aggrieved person has been treated (if any);

b) vtv5 trực tiếp bóng đá hôm nay actual lost income of vtv5 trực tiếp bóng đá hôm nay caregiver(s) of vtv5 trực tiếp bóng đá hôm nay aggrieved person during vtv5 trực tiếp bóng đá hôm nay treatment period is determined according to vtv5 trực tiếp bóng đá hôm nay guidance in Clause 2 of this Article;

c) In case vtv5 trực tiếp bóng đá hôm nay aggrieved person loses his/her capacity to work and must be taken care of by someone regularly, vtv5 trực tiếp bóng đá hôm nay reasonable expense for taking care of vtv5 trực tiếp bóng đá hôm nay aggrieved person is determined to be 01 day of regional minimum wage in vtv5 trực tiếp bóng đá hôm nay place where vtv5 trực tiếp bóng đá hôm nay aggrieved person resides for 01 day to take care of vtv5 trực tiếp bóng đá hôm nay aggrieved person.

Therefore, based on vtv5 trực tiếp bóng đá hôm nay aforementioned regulations, vtv5 trực tiếp bóng đá hôm nay compensation for permanent disability will include various monetary amounts such as: expenses for medical treatment, rehabilitation, and restoration of vtv5 trực tiếp bóng đá hôm nay lost or diminished health and function of vtv5 trực tiếp bóng đá hôm nay permanently disabled person; actual income that is lost or reduced of vtv5 trực tiếp bóng đá hôm nay permanently disabled person; reasonable expenses; and vtv5 trực tiếp bóng đá hôm nay actual income lost by vtv5 trực tiếp bóng đá hôm nay caregiver of vtv5 trực tiếp bóng đá hôm nay permanently disabled person.
