Deposit is one of nine types of security for performance of obligations specified in Article 292 of lịch trực tiếp bóng đá hôm nayLaw No. 91/2015/QH13. Article 328 of lịch trực tiếp bóng đá hôm nayLaw No. 91/2015/QH13specifically stipulates deposits as follows:

"1. Deposit is an act whereby one party (hereinafter referred to as lịch trực tiếp bóng đá hôm nay depositor) transfers to another party (hereinafter referred to as lịch trực tiếp bóng đá hôm nay depositary) a sum of money or precious metals, gemstones or other valuable things (hereinafter referred to as lịch trực tiếp bóng đá hôm nay deposited property) for a period of time as security for lịch trực tiếp bóng đá hôm nay entering into or performance of a contract.

2. Upon a contract being entered into or performed, any deposited property shall be returned to lịch trực tiếp bóng đá hôm nay depositor, or deducted from lịch trực tiếp bóng đá hôm nay amount of an obligation to pay money. If lịch trực tiếp bóng đá hôm nay depositor refuses to enter into or perform lịch trực tiếp bóng đá hôm nay contract, lịch trực tiếp bóng đá hôm nay deposited property shall belong to lịch trực tiếp bóng đá hôm nay depositary. If lịch trực tiếp bóng đá hôm nay depositary refuses to enter into or perform lịch trực tiếp bóng đá hôm nay contract, it must return lịch trực tiếp bóng đá hôm nay deposited property and pay an amount equivalent to lịch trực tiếp bóng đá hôm nay value of lịch trực tiếp bóng đá hôm nay deposited property to lịch trực tiếp bóng đá hôm nay depositor, unless otherwise agreed."

Therefore, on July 29, 2019, Mr. A sued Mr. B, demanding that he fulfill his obligation to return lịch trực tiếp bóng đá hôm nay received deposit of 1 billion VND and compensate 3 billion VND according to lịch trực tiếp bóng đá hôm nay agreement of lịch trực tiếp bóng đá hôm nay deposit contract. However, Mr. B refused to sign lịch trực tiếp bóng đá hôm nay transfer contract, which is a violation of lịch trực tiếp bóng đá hôm nay agreement, so Mr. B must refund lịch trực tiếp bóng đá hôm nay plaintiff (Mr. A) lịch trực tiếp bóng đá hôm nay amount of 1 billion VND and compensate 3 billion VND, which is appropriate, for lịch trực tiếp bóng đá hôm nay following reasons:

On March 8, 2018, Mr. B and Mr. A signed a deposit contract to ensure lịch trực tiếp bóng đá hôm nay signing of lịch trực tiếp bóng đá hôm nay transfer contract for lịch trực tiếp bóng đá hôm nay use rights of 12 plots of land in X district for a price of 6 billion VND, with a deposit agreed upon of 1 billion VND. This is a voluntary agreement, not against social ethics, and does not violate lịch trực tiếp bóng đá hôm nay prohibitions of lịch trực tiếp bóng đá hôm nay law. lịch trực tiếp bóng đá hôm nay court has made a mistake in applying lịch trực tiếp bóng đá hôm nay law because lịch trực tiếp bóng đá hôm nay deposit contract on March 8, 2018 is a "promise to buy, promise to sell" when there are sufficient conditions, not a transfer contract for lịch trực tiếp bóng đá hôm nay use rights of lịch trực tiếp bóng đá hôm nay land, so it is not against social ethics, does not violate Article 117 of lịch trực tiếp bóng đá hôm nay Civil Code 2015, and Clause 1 of Article 188 of lịch trực tiếp bóng đá hôm nayxem bóng đá trực, which means it is not null and void.

Therefore, Mr. A has fulfilled lịch trực tiếp bóng đá hôm nay obligations according to lịch trực tiếp bóng đá hôm nay agreement in lịch trực tiếp bóng đá hôm nay deposit contract. lịch trực tiếp bóng đá hôm nay judgment of lịch trực tiếp bóng đá hôm nay Provincial People's Court of Y in lịch trực tiếp bóng đá hôm nay dispute case "transfer contract for lịch trực tiếp bóng đá hôm nay use rights of lịch trực tiếp bóng đá hôm nay land" between Mr. B and Ms. C has declared that Mr. B is lịch trực tiếp bóng đá hôm nay rightful owner of lịch trực tiếp bóng đá hôm nay use rights for lịch trực tiếp bóng đá hôm nay 12 plots of land. Since December 5, 2019, Mr. B has had sufficient conditions to transfer lịch trực tiếp bóng đá hôm nay use rights of lịch trực tiếp bóng đá hôm nay plots of land to Mr. A according to lịch trực tiếp bóng đá hôm nay conditions of lịch trực tiếp bóng đá hôm nay deposit contract. Mr. B believes that because Mr. A filed a lawsuit against him when he did not have sufficient conditions to transfer lịch trực tiếp bóng đá hôm nay rights, Mr. A has violated lịch trực tiếp bóng đá hôm nay contract and lost lịch trực tiếp bóng đá hôm nay deposit.
