Public Employee

A public employee is a Vietnamese citizen who is recruited into a job position, works at a public service provider according to vtv5 trực tiếp bóng đá hôm nay policies of vtv5 trực tiếp bóng đá hôm nay employment contract, and receives a salary from vtv5 trực tiếp bóng đá hôm nay salary fund of vtv5 trực tiếp bóng đá hôm nay public service provider in accordance with vtv5 trực tiếp bóng đá hôm nay law.

Based on Clause 3, Article 29 of vtv5 trực tiếp bóng đá hôm nayPublic Employees Law 2010stipulating vtv5 trực tiếp bóng đá hôm nay unilateral termination of an employment contract as follows:

Unilateral Termination of Employment Contract

a) vtv5 trực tiếp bóng đá hôm nay public employee is sick or injured, undergoing treatment for occupational diseases as determined by a medical facility, except for vtv5 trực tiếp bóng đá hôm nay case specified at Point c, Clause 1 of this Article;

b) vtv5 trực tiếp bóng đá hôm nay public employee is on annual leave, personal leave, and other types of leave permitted by vtv5 trực tiếp bóng đá hôm nay head of vtv5 trực tiếp bóng đá hôm nay public service provider;

c) vtv5 trực tiếp bóng đá hôm nay female public employee is pregnant, on maternity leave, or nursing a child under 36 months of age, except when vtv5 trực tiếp bóng đá hôm nay public service provider ceases its operation.

Therefore, a teacher who is a public employee will not have their employment contract unilaterally terminated if they fall into vtv5 trực tiếp bóng đá hôm nay following cases:

- vtv5 trực tiếp bóng đá hôm nay teacher is sick or injured, undergoing treatment for occupational diseases as determined by a medical facility;

- vtv5 trực tiếp bóng đá hôm nay teacher is on annual leave, personal leave, and other types of leave permitted by vtv5 trực tiếp bóng đá hôm nay head of vtv5 trực tiếp bóng đá hôm nay public service provider;

Based on Article 53 of vtv5 trực tiếp bóng đá hôm nayPublic Employees Law 2010as amended by Clause 7, Article 2 of vtv5 trực tiếp bóng đá hôm nayLaw on Public Officials and Officials and vtv5 trực tiếp bóng đá hôm nay Amended Public Employees Law 2019stipulating vtv5 trực tiếp bóng đá hôm nay statute of limitations for disciplining as follows:

Statute of Limitations and Time Limits for Disciplining

  1. vtv5 trực tiếp bóng đá hôm nay statute of limitations for disciplining is vtv5 trực tiếp bóng đá hôm nay period after which vtv5 trực tiếp bóng đá hôm nay public employee, who commits a violation, is not disciplined. vtv5 trực tiếp bóng đá hôm nay statute of limitations for disciplining is counted from vtv5 trực tiếp bóng đá hôm nay time vtv5 trực tiếp bóng đá hôm nay violation occurs.

Except for vtv5 trực tiếp bóng đá hôm nay cases specified in Clause 2 of this Article, vtv5 trực tiếp bóng đá hôm nay statute of limitations for disciplining is stipulated as follows:

c) Violating national security interests in vtv5 trực tiếp bóng đá hôm nay fields of defense, security, and foreign affairs;

d) Using fake or unauthorized degrees, certificates, or any type of false documentation.

  1. vtv5 trực tiếp bóng đá hôm nay disciplinary time limit for a public employee is vtv5 trực tiếp bóng đá hôm nay period from vtv5 trực tiếp bóng đá hôm nay discovery of vtv5 trực tiếp bóng đá hôm nay violation to vtv5 trực tiếp bóng đá hôm nay issuance of vtv5 trực tiếp bóng đá hôm nay disciplinary decision by vtv5 trực tiếp bóng đá hôm nay competent authority.

Pursuant to Article 3 ofDecree 112/2020/ND-CPas amended by Clause 3, Article 1 ofDecree 71/2023/ND-CPstipulates as follows:

Cases Not Yet Considered for Disciplinary Review

  1. Officials and public employees who are on annual leave, leave under policies, or personal leave with permission from vtv5 trực tiếp bóng đá hôm nay competent authority.

  2. Officials and public employees who are undergoing treatment for serious illnesses or are losing cognitive abilities; severely ill and being treated as an inpatient at a hospital with certification from a competent medical authority.

  3. Female officials and public employees who are pregnant, on maternity leave, nursing a child under 12 months of age, or male officials and public employees (in cases where vtv5 trực tiếp bóng đá hôm nay wife is deceased or due to objective and force majeure reasons) nursing a child under 12 months of age, except in cases where vtv5 trực tiếp bóng đá hôm nay person committing vtv5 trực tiếp bóng đá hôm nay violation requests disciplinary review in writing.
