What is countervailing duty?

According to Clause 6, Article 4 of bóng đá hôm nay trực tiếpLaw on Export and Import Duties 2016, countervailing duty is an additional import duty applied when subsidized goods are imported into Vietnam, causing or threatening to cause significant damage to bóng đá hôm nay trực tiếp domestic industry or impeding bóng đá hôm nay trực tiếp establishment of a domestic industry.

When shall bóng đá hôm nay trực tiếp Minister of Industry and Trade of Vietnam decide bóng đá hôm nay trực tiếp retroactivity of countervailing duties?

Based on bóng đá hôm nay trực tiếp provisions of Clause 4, Article 89 of bóng đá hôm nay trực tiếpLaw on Foreign Trade Management 2017, bóng đá hôm nay trực tiếp application of countervailing duty retroactively is implemented as follows:

Application of Countervailing Measures

1. bóng đá hôm nay trực tiếp temporary application of countervailing duty is decided by bóng đá hôm nay trực tiếp Minister of Industry and Trade based on bóng đá hôm nay trực tiếp preliminary determination of bóng đá hôm nay trực tiếp Investigating Authority. bóng đá hôm nay trực tiếp temporary countervailing duty must not exceed bóng đá hôm nay trực tiếp subsidy level determined in bóng đá hôm nay trực tiếp preliminary result.

bóng đá hôm nay trực tiếp period for applying temporary countervailing duty must not exceed 120 days from bóng đá hôm nay trực tiếp effective date of bóng đá hôm nay trực tiếp decision to apply temporary countervailing duty. bóng đá hôm nay trực tiếp Minister of Industry and Trade may extend bóng đá hôm nay trực tiếp application period but not beyond 60 days.

2. bóng đá hôm nay trực tiếp application of commitment measures is implemented as follows:

a) After bóng đá hôm nay trực tiếp preliminary conclusion and before bóng đá hôm nay trực tiếp end of bóng đá hôm nay trực tiếp investigation, bóng đá hôm nay trực tiếp organizations, individuals producing, exporting investigated goods, or bóng đá hôm nay trực tiếp government providing subsidies may propose commitments to bóng đá hôm nay trực tiếp Investigating Authority to voluntarily cease subsidies, reduce subsidy levels, commit to adjust export prices, or apply other suitable measures;

b) bóng đá hôm nay trực tiếp Investigating Authority may accept, decline, or suggest adjustments to bóng đá hôm nay trực tiếp commitments based on consultations with organizations, individuals representing bóng đá hôm nay trực tiếp domestic industry.

3. bóng đá hôm nay trực tiếp application of countervailing duty is implemented as follows:

a) If no agreement is reached according to Clause 2 of this Article, upon bóng đá hôm nay trực tiếp completion of bóng đá hôm nay trực tiếp investigation, bóng đá hôm nay trực tiếp Investigating Authority will announce bóng đá hôm nay trực tiếp final determination concerning bóng đá hôm nay trực tiếp investigation issues as stipulated in Article 88 of this Law. bóng đá hôm nay trực tiếp final determination and bóng đá hôm nay trực tiếp main bases for it must be notified in an appropriate manner to bóng đá hôm nay trực tiếp related parties;

b) Based on bóng đá hôm nay trực tiếp final determination of bóng đá hôm nay trực tiếp Investigating Authority, bóng đá hôm nay trực tiếp Minister of Industry and Trade will decide whether or not to apply countervailing duty;

c) bóng đá hôm nay trực tiếp level of countervailing duty must not exceed bóng đá hôm nay trực tiếp subsidy level found in bóng đá hôm nay trực tiếp final determination;

d) bóng đá hôm nay trực tiếp duration for applying countervailing duty is not more than five years from bóng đá hôm nay trực tiếp effective date of bóng đá hôm nay trực tiếp decision to apply bóng đá hôm nay trực tiếp duty, unless extended as stipulated in Clause 2, Article 90 of this Law.

4. bóng đá hôm nay trực tiếp retroactive application of countervailing duty is implemented as follows:

a) If bóng đá hôm nay trực tiếp final determination of bóng đá hôm nay trực tiếp Investigating Authority identifies significant damage or a threat of significant damage to bóng đá hôm nay trực tiếp domestic industry, bóng đá hôm nay trực tiếp Minister of Industry and Trade may decide to apply countervailing duty retroactively;

b) Retroactive countervailing duty may be applied to goods imported within 90 days prior to bóng đá hôm nay trực tiếp application of temporary countervailing duty if these goods are found to be subsidized; bóng đá hôm nay trực tiếp volume or quantity of subsidized imported goods into Vietnam rapidly increases remarkably during bóng đá hôm nay trực tiếp period from bóng đá hôm nay trực tiếp initiation of bóng đá hôm nay trực tiếp investigation to bóng đá hôm nay trực tiếp imposition of temporary countervailing duty and causes non-recoverable damage to bóng đá hôm nay trực tiếp domestic industry.

5. bóng đá hôm nay trực tiếp application of other countervailing measures is carried out in accordance with international agreements to which bóng đá hôm nay trực tiếp Socialist Republic of Vietnam is a member or based on principles of international law.

Therefore,bóng đá hôm nay trực tiếp Minister of Industry and Trade can decide to apply countervailing duty retroactively if bóng đá hôm nay trực tiếp final determination of bóng đá hôm nay trực tiếp Investigating Authority identifies significant damage or a threat of significant damage to bóng đá hôm nay trực tiếp domestic industry.

Whatfactorsare used fordetermination of significant damage to bóng đá hôm nay trực tiếp industryin Vietnam?

bóng đá hôm nay trực tiếp determination of significant damage to bóng đá hôm nay trực tiếp domestic industry is based on considering bóng đá hôm nay trực tiếp factors stipulated in Clause 1, Article 23 ofDecree 10/2018/ND-CPas follows:

- bóng đá hôm nay trực tiếp absolute or relative increase in bóng đá hôm nay trực tiếp volume or quantity of dumped or subsidized goods imported into Vietnam compared to bóng đá hôm nay trực tiếp volume or quantity of similar goods produced domestically or consumed in bóng đá hôm nay trực tiếp domestic market;

- bóng đá hôm nay trực tiếp price undercutting or price suppression impact of bóng đá hôm nay trực tiếp investigated imported goods on bóng đá hôm nay trực tiếp selling price of similar goods produced domestically;

- bóng đá hôm nay trực tiếp impact of dumped or subsidized goods on bóng đá hôm nay trực tiếp operational status of bóng đá hôm nay trực tiếp domestic industry's production, including bóng đá hôm nay trực tiếp actual decline or potential decline in revenue, sales volume, profit, production output, market share, capacity, productivity, investment; factors affecting domestic selling price; bóng đá hôm nay trực tiếp magnitude of bóng đá hôm nay trực tiếp dumping margin, subsidy level; and adverse actual and potential effects on cash flow, inventory, labor, wages, financial mobilization capacity;

- Other influencing factors.
