Shall an employee with a contract of less than 6 months be subject to enforcement by deduction of money from xem bóng đá trực tiếp nhà cái taxpayer’ salary or income in Vietnam?

Based on Clause 1, Article 130 of xem bóng đá trực tiếp nhà cái2019 Law on Tax Administration, it is stipulated as follows:

Enforcement by deducting money from xem bóng đá trực tiếp nhà cái taxpayer’s salary or income

1. Wage or income deduction measures are applied to taxpayers subject to enforcement of tax enforcement decisions who are working under permanent payrolls or contracts for 06 months or more, or who are receiving retirement or disability benefits.

2. xem bóng đá trực tiếp nhà cái deduction rate for wages, retirement, or disability benefits for an individual is not less than 10% and not more than 30% of xem bóng đá trực tiếp nhà cái individual's total monthly wages or benefits; for other income, xem bóng đá trực tiếp nhà cái deduction rate is based on actual income but not more than 50% of xem bóng đá trực tiếp nhà cái total income.

3. xem bóng đá trực tiếp nhà cái agency, organization employing xem bóng đá trực tiếp nhà cái laborer managing xem bóng đá trực tiếp nhà cái wages or income of xem bóng đá trực tiếp nhà cái individual subject to xem bóng đá trực tiếp nhà cái enforcement of tax enforcement decisions has xem bóng đá trực tiếp nhà cái following responsibilities:

a) Deduct a portion of xem bóng đá trực tiếp nhà cái wages or income of xem bóng đá trực tiếp nhà cái individual to enforce xem bóng đá trực tiếp nhà cái administrative decision on tax management and transfer xem bóng đá trực tiếp nhà cái deducted amount into xem bóng đá trực tiếp nhà cái state budget account at xem bóng đá trực tiếp nhà cái State Treasury as specified in xem bóng đá trực tiếp nhà cái decision of enforcement of xem bóng đá trực tiếp nhà cái administrative decision on tax management from xem bóng đá trực tiếp nhà cái nearest payment period for wages or income until xem bóng đá trực tiếp nhà cái full amount of tax debt is deducted according to xem bóng đá trực tiếp nhà cái enforcement decision on xem bóng đá trực tiếp nhà cái administrative decision on tax management, and simultaneously notify xem bóng đá trực tiếp nhà cái decision issuer and xem bóng đá trực tiếp nhà cái individual concerned;

b) In xem bóng đá trực tiếp nhà cái case where xem bóng đá trực tiếp nhà cái tax debt has not been fully deducted according to xem bóng đá trực tiếp nhà cái enforcement decision and xem bóng đá trực tiếp nhà cái labor contract of xem bóng đá trực tiếp nhà cái individual subject to enforcement is terminated, xem bóng đá trực tiếp nhà cái employing agency or organization must notify xem bóng đá trực tiếp nhà cái issuer of xem bóng đá trực tiếp nhà cái enforcement decision on xem bóng đá trực tiếp nhà cái administrative decision on tax management within 05 working days from xem bóng đá trực tiếp nhà cái date xem bóng đá trực tiếp nhà cái labor contract is terminated;

c) xem bóng đá trực tiếp nhà cái agency or organization employing xem bóng đá trực tiếp nhà cái laborer managing xem bóng đá trực tiếp nhà cái wages or income of xem bóng đá trực tiếp nhà cái individual subject to enforcement of tax enforcement decisions intentionally does not implement xem bóng đá trực tiếp nhà cái enforcement decision on xem bóng đá trực tiếp nhà cái administrative decision on tax management shall be fined according to xem bóng đá trực tiếp nhà cái administrative violations stipulated in Chapter XV of this Law.

Thus,under xem bóng đá trực tiếp nhà cái above regulation, an employee with a contract of less than 6 months will not be subject to enforcement by deduction of money from xem bóng đá trực tiếp nhà cái taxpayer’ salary or income.

b) tax enforcement decisions include: decisions on administrative penalties related to tax management; notices of tax determination, tax determination decisions; notices of tax arrears; decisions on recovery of refunds; extension decisions; installment payment decisions; decisions to terminate xem bóng đá trực tiếp nhà cái validity of xem bóng đá trực tiếp nhà cái decision on tax debt reservation; decisions on xem bóng đá trực tiếp nhà cái application of remedial measures according to xem bóng đá trực tiếp nhà cái law on handling administrative violations related to tax management; decisions on compensation for damages; other tax enforcement decisions according to xem bóng đá trực tiếp nhà cái law.

Thus,decisions on administrative penalties related to tax management;

Notices of tax determination, tax determination decisions;

Notices of tax arrears;

Decisions on recovery of refunds;

Extension decisions;

Installment payment decisions;

Decisions to terminate xem bóng đá trực tiếp nhà cái validity of xem bóng đá trực tiếp nhà cái decision on tax debt reservation;

Decisions on xem bóng đá trực tiếp nhà cái application of remedial measures according to xem bóng đá trực tiếp nhà cái law on handling administrative violations related to tax management;

Decisions on compensation for damages;

Other tax enforcement decisions according to xem bóng đá trực tiếp nhà cái law.

- In case xem bóng đá trực tiếp nhà cái tax debt has not been fully deducted according to xem bóng đá trực tiếp nhà cái enforcement decision and xem bóng đá trực tiếp nhà cái labor contract of xem bóng đá trực tiếp nhà cái person subject to enforcement is terminated, xem bóng đá trực tiếp nhà cái employing agency or organization must notify xem bóng đá trực tiếp nhà cái issuer of xem bóng đá trực tiếp nhà cái enforcement decision on tax enforcement decisions within 05 working days from xem bóng đá trực tiếp nhà cái termination date of xem bóng đá trực tiếp nhà cái labor contract.

If xem bóng đá trực tiếp nhà cái agency or organization employing and managing xem bóng đá trực tiếp nhà cái wages or income of xem bóng đá trực tiếp nhà cái person subject to enforcement of tax enforcement decisions intentionally does not implement xem bóng đá trực tiếp nhà cái enforcement decision on tax enforcement decisions, it shall be fined for administrative violations.
